These conditions are valid between Pops Medical Srl, with registered office in Via Einstein 6 - 48018 Faenza (RA) CF / VAT number: IT0254680394, and any person who makes online purchases on the website www.popsmedical.com hereinafter referred to as "CUSTOMER".
The products purchased on the website www.popsmedical.com are sold directly by Pops Medical Srl.S.
These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern the purchases made on the website www.popsmedical.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, modified by Legislative Decree n. 21/2014 and Legislative Decree 70/2003 on electronic commerce.
ARTICLE 1 - Object of the contract
With these general conditions of sale, Pops Medical Srl.S sells and the CUSTOMER remotely purchases the tangible movable goods indicated and offered for sale on the website www.popsmedical.com.
The contract is concluded through the internet, by accessing the CUSTOMER at www.popsmedical.com and making a purchase order according to the procedure provided by the site itself. The CUSTOMER undertakes to read, before proceeding to confirm his order, these general conditions of sale, in particular the pre-contractual information provided by Pops Medical Srl.S and to accept them by order confirmation.
In the order confirmation email, the CUSTOMER will also receive information to consult these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, modified by Legislative Decree 21/2014.
Given the characteristics of the products indicated and offered for sale on the website www.popsmedical.com, the CUSTOMER, by filling in and confirming the purchase order, declares to be a Professional / Operator in the dental sector (Dentist, Surgeon, Odontostomatologist, Dental technician ...) assuming all responsibility for false declarations and for the truthfulness and correctness of the tax data provided for the conclusion of the sales procedure (processing of the order, issue of tax documents, shipment of goods by courier, payment of goods).
ARTICLE 2 - Pre-contractual information for the consumer - art. 49 of Legislative Decree 206/2005
Before the conclusion of the purchase contract, the CUSTOMER examines the characteristics of the goods that are illustrated in the individual product sheets at the time of choice. Before the conclusion of the purchase contract and before the validation of the order, the CUSTOMER is informed about:

- The methods of payment
- The conditions, terms and procedures for exercising the right of withdrawal (art.6 of these conditions) as well as the model withdrawal form referred to in Annex I, part B of Legislative Decree 21/2014

ARTICLE 3 - Conclusion and effectiveness of the contract
The sales contract is considered concluded with the sending by Pops Medical Srl.S to the CUSTOMER of an order confirmation email. The order confirmation email contains the CUSTOMER's data, the number and date of the order, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the indication for consult these general conditions of sale.
The CUSTOMER undertakes to verify the correctness of the personal tax and commercial data provided with the completion of the order, which are replicated in the order confirmation email. The CUSTOMER undertakes to promptly notify Pops Medical Srl of any errors, variations, corrections.
Pops Medical Srl.S undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the site and the actual product may be highlighted. The photographs and drawings of the products presented on the website www.popsmedical.com do not constitute a contractual element as they are only representative.
Pops Medical Srl.S undertakes to deliver the goods within 30 days from the sending of the order confirmation email to the CUSTOMER.
The products ordered and purchased by the customer are intended exclusively for the country / country indicated on the order. Pops Medical Srl.S declines all responsibility in the event that the CUSTOMER decides to enter the products ordered and purchased in a different country / country.
ARTICLE 4 - Availability of products
Product availability refers to actual availability at the time the CUSTOMER places the order. The availability of the products must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other CUSTOMERS before confirming the order.
Even after sending the order confirmation email sent by Pops Medical Srl, there may be cases of partial or total unavailability of the goods. It is understood that the fulfillment of the orders for which the CUSTOMER has chosen to pay in advance by bank transfer, will be subject to the receipt, via email at the address: firstname.lastname@example.org, of the accounting copy of the bank transfer bearing the CRO number.

ARTICLE 6 - Prices

The CUSTOMER accepts the right of Pops Medical Srl to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site when the order is created and indicated in the confirmation email sent by Pops Medical Srl.S to the CUSTOMER.
In the event of an IT, manual, technical, or any other error that may result in a substantial change, not foreseen by Pops Medical Srl.S, of the sale price indicated on the site, which makes it exorbitant or clearly negligible, the order of purchase will be considered invalid and canceled and the amount eventually paid by the CUSTOMER will be refunded within 14 days. from the day of cancellation.
ARTICLE 7 - Right of withdrawal and returns
In accordance with the provisions of the law in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days from the date of receipt of the products.
The CUSTOMER who intends to exercise the right of withdrawal must previously communicate it to Pops Medical Srl.S through an explicit declaration, which can be sent by registered letter with return receipt or by e-mail.
The CUSTOMER may exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 (not mandatory) whose text is shown below:

In case of exercise of the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which he communicated to Pops Medical Srl. His will to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.
The products must be returned unused, intact, undamaged, in the original packaging, complete in all their parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation. Pops Medical Srl.S reserves the right to credit and reimburse the returned value at a lower value than the purchase value by the CUSTOMER, if the above conditions are not respected.
Without prejudice to the right to verify compliance with the above, Pops Medical Srl will refund the amount of the products subject to withdrawal within a maximum period of 14 days.

which undertakes to verify and evaluate the conditions of the returned goods, crediting the CUSTOMER with the issue of the regular accounting document (e.g. Credit Note).
The direct costs of returning the products are the responsibility of the CUSTOMER, unless expressly exempted by Pops Medical Srl. and to the further condition that the CUSTOMER uses the Courier indicated by Pops Medical Srl.S.
As required by art. 56 paragraph 3 of Legislative Decree 206/2005, modified by Legislative Decree 21/2014, Pops Medical Srl.S can suspend the refund until receipt of the goods or until the CLIENT demonstrates that he has returned the goods to Pops Medical Srl.S. Pops Medical Srl.S will carry out the refund by bank transfer and if the CUSTOMER intends to exercise his right of withdrawal, he must provide Pops Medical Srl.S with the complete bank details: IBAN, SWIFT and BIC and all other data deemed necessary for the reimbursement.
ARTICLE 8 - Legal guarantee of conformity
In case of receipt of products that do not comply with the intended use or are defective, the CUSTOMER has the right to restore the conformity of the product at no cost by repairing or replacing the product. The CUSTOMER can exercise this right if the defect occurs within two years from the delivery of the goods and reports the defect to Pops Medical Srl.S within two months of discovery.

ARTICLE 10 - Delivery methods and tax documents
The ordered products will be delivered by express courier to the address indicated by the CUSTOMER when ordering no later than 10 days. from the date of receipt by the CUSTOMER of the order confirmation email sent by Pops Medical Srl.S. For each order processed, appropriate tax documentation is issued to accompany the goods shipped. ARTICLE 11 - Responsibility
Pops Medical Srl.S does not assume any responsibility for disservices attributable due to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet, in the event that it is unable to execute the order within the time foreseen by the contract. The CUSTOMER has the right to access the site for consultation and making purchases. No other use, in particular commercial, of the site or its content is permitted.

ARTICLE 14 - Applicable law and competent court
These General Conditions of Sale are governed by Italian law.
